Civil

Commission Records
The Clerk and Comptroller's Commission Records Division retains the records of the Board of County Commissioners (BOCC).

Criminal
The Criminal Division is located on the second floor of the Constitutional Building. Juvenile Delinquency services are also located within our Criminal Division, and handles criminal court cases involving individuals under the age of 18, who have not been charged as an adult.

Finance & Budget
The Division of Financial Services is responsible for the accounting functions of the Board of County Commissioners, the Clerk of the Circuit Court and Comptroller, and the Supervisor of Elections.

Foreclosure sales are sales of properties ordered to be sold pursuant to final judgments in foreclosure actions.

Injunctions & Mental Health Petitions
The Special Services Division handles the filing and processing of Civil Injunctions for Protection; Involuntary Examination Petitions (Baker Act); Involuntary Assessment and Stabilization Petitions (Marchman Act); and Risk Protection Orders.

Jury Duty
The Jury Administration and Assembly Room is located on the 1st Floor of the Martin County Courthouse Complex, Constitutional Building, at 100 SE Ocean Boulevard, Stuart, Florida 34994.

Marriage Licenses
The Clerk of the Circuit Court acts as an agent for the State of Florida for issuing marriage licenses as outlined in chapter 741, Florida Statutes.

Official Records
The Clerk of Circuit Court and Comptroller is also the County Recorder. The Recording Department records, indexes, and archives all of the documents that create the Official Records of Martin County.

Passport Services are available at our Main Office in Stuart and Hobe Sound Branch by appointment only.

Probate & Guardianship
Probate is the legal process through which a deceased person's assets are distributed to the heirs or beneficiaries, according to the wishes of the deceased as stated in The Last Will and Testament or if there is no will, according to Florida Law.

Risk Protection Orders
The Special Services Division handles the filing and processing of Civil Injunctions for Protection; Involuntary Examination Petitions (Baker Act); Involuntary Assessment and Stabilization Petitions (Marchman Act); and Risk Protection Orders.

Small Claims
A Small Claims case is a legal action filed in County court to settle minor legal disputes among parties where the dollar amount involved is $8,000.00 or less, excluding costs, interest, and attorney fees.

The Value Adjustment Board (VAB) is an independent board created by Florida Statute Chapter 194.
