The Clerk of the Circuit Court acts as an agent for the State of Florida for issuing marriage licenses as outlined in chapter 741, Florida Statutes.
The Martin County Clerk's Office issues marriage licenses to all qualifying couples. This service is available in the main courthouse and branch offices during regular posted hours.

The Martin County Clerk's Office issues marriage licenses to all qualifying couples. This service is available in the main courthouse and branch offices during regular posted hours.
Requirements:
- Both parties must be present and provide valid identification (valid drivers license, state I.D. card or passport).
- If previously married, the month, day and year that the previous marriage ended must be provided.
- The fee for a marriage license is $86 and may be paid using cash or credit card. When using a credit card a transaction fee of 3.5% will be charged.
- This fee may be reduced to $61 if the parties participate in an approved premarital preparation course provided by a Qualified Course Provider who is registered with this office. A list of these registered qualified course providers is available in the Clerk’s Office. The course provider must furnish the parties with a Certificate of Completion which must be presented to the Clerk’s Office when applying for the marriage license, in order to receive the reduced fee.
- Waiting Period:
- Non-Florida residents - no waiting period
- Florida residents who participate in premarital preparation course - no waiting period
- Florida residents who do not participate in premarital preparation course - 3 day waiting period
- Both parties are required to read the Family Law Handbook (English (PDF) / Spanish (PDF)) prior to applying for a marriage license. Copies of the Handbook are available in our office. Florida law requires you to sign a statement, verifying that you have read the handbook.
- Florida law requires each party to provide the Clerk’s office with their social security number, passport number, alien admission number, or alien file number.
- Blood tests are not required.
- The marriage license is valid for 60 days after issuance.
- The marriage must be solemnized within the State of Florida by an official authorized by chapter 741, Florida Statutes, such as a notary, clerk, ordained clergy, or judicial officer.
- Witnesses are not required.
Marriage ceremonies are performed by appointment only. Please call 772-288-5551 to schedule your ceremony.
The Martin County Clerk of the Circuit Court's Office provides the service of solemnizing marriage ceremonies through the Official Records Division. The fee to perform a ceremony is $30.
Officials authorized by chapter 741, Florida Statutes, such as a notary, ordained clergy, or judicial officer (judge) are also authorized to solemnize your marriage.
- You can access images of recorded marriage licenses (from January 1, 1999, forward) at our Official Records portal. For assistance with records prior to January 1, 1999, please call 772-288-5551.
- The charge for a copy is $1 per page and an additional $2 to certify the document, if certification is needed. If you are going to use a copy for a legal purpose, you may want to have the copy certified. There is no charge to view a document online or in the clerk's office.
- You may also send a written request for a copy. Please provide the name of each spouse at the time they applied for the license, and if known, date of marriage. Please make checks payable to Clerk of the Circuit Court. The mailing address is Clerk of the Circuit Court, Official Records, Post Office Box 9016, Stuart, Florida 34995-9016.
It is essential that we maintain an accurate public record of marriages performed in Martin County, Florida. The following tips will help you to perform error free ceremonies:
- Florida law requires that, before you solemnize any marriage, the parties must present a marriage license issued by the Clerk of the Circuit Court.
- Section 741.08, Florida Statutes, require that within 10 days after performing the marriage, you must sign the Certificate on the license and return it to this office.
- We provided a self-addressed envelope. Please put your correct return address on the envelope in case we need to contact you.
- If you are a Notary Public, you must affix your seal, your signature and your printed name, the expiration date of your commission, and your commission number.
- If you are of any religious order that has a seal, you are encouraged to affix your seal.
- Complete the Certificate with black ink. Do not use red ink.
